PROSECUTOR: Deputy District Attorney Kelly Clark, Adult Sexual Assault Prosecution

The Honorable James Arguelles sentenced Erick Brandon to 54 years to life in prison.  On November 8, 2023, a jury convicted Brandon of forcible rape and assault with intent to commit rape/sodomy/oral copulation with aggravating factors found true.  The jury also found true that Brandon has a prior strike conviction for carjacking and two prior strike convictions for robbery. Brandon had previously pled to felon in possession of a firearm.

The victim allowed Brandon to stay at her apartment until he was able to move into his own place.  On February 7, 2023, Brandon entered the victim’s bedroom while she was sleeping and raped the victim as she continually told him “no.”  As he left the room, he told her that he would be back to finish.  On February 8, 2023, Brandon entered the victim’s bedroom again and attempted to sexually assault her.  The victim was able to get to a place of safety and report the assaults.
