Defendant Convicted of Attempted Murder, Shooting at Citrus Heights Restaurant

Miguel Angel Garcia-Rocio was convicted by a jury of attempted murder.  The jury also found true allegations of willful, deliberation, and premeditation; personal use of a firearm; and intentional discharge of a firearm.

On April 16, 2021, Miguel Angel Garcia-Rocio was having dinner at a restaurant with a small group, including children.  Garcia-Rocio was making the children laugh when a group of males at a nearby table began laughing at him.  Garcia-Rocio got angry and started an argument.  Garcia-Rocio later went to the parking lot and moved his car closer to the outdoor patio where all of the parties were sitting. Garcia-Rocio returned to his table and continued arguing with the group of males. Garcia-Rocio then walked up to the other group’s table, pulled a handgun from his waist and shot the victim once in the head.  Garcia-Rocio then got into his nearby car and fled the scene.  He was apprehended later that night.  The victim suffered a graze head wound which required suturing.

Garcia-Rocio faces a maximum sentence of 27 years to life in prison.  Sentencing is set for December 9, 2022, at 2:30 p.m. in Department 36 before the Honorable Stephen Acquisto.
