CASE:  Cesar Serpas & Joseph Garcia (Case #19FE001752)

Cesar Serpas was convicted by a jury of robbery with personal use of a firearm, assault with a semi-automatic firearm, attempted voluntary manslaughter, attempted carjacking with personal use of a firearm, and felon in possession of a firearm.  Joseph Garcia was convicted of robbery and attempted carjacking.

On September 11, 2018, the victims went to Dimple Records on Arden Way to buy a CD.  As they were leaving, Serpas and Garcia robbed them at gunpoint and attempted to steal one of the victim’s car.  When one of the victims ran back into the store, Serpas fired several shots at him with a handgun.  The handgun was never recovered.

An allegation that Serpas suffered a prior 2013 strike conviction for assault causing great bodily injury will be determined at sentencing.

Serpas faces a maximum sentence of 54 years and 4 months in prison. Garcia faces a maximum sentence of 5 years in prison.  Sentencing is set for October 1, 2021, at 11:00 a.m. in Department 17 before the Honorable James Arguelles.
