Theo Simmons was convicted by a jury of four counts of robbery. The jury also found true that Simmons personally used a firearm during two of the robberies.
On New Year’s Eve 2015, Theo Simmons and a juvenile accomplice entered a Walgreens in Rancho Cordova armed with a firearm. Both defendants went to the pharmacy and jumped the counter looking for drugs. Simmons jammed the gun in the side of a victim and forced her in the back where the drugs were kept. The juvenile grabbed the other victim and ordered her to provide him with drugs. They placed the pill bottles into a backpack and fled the store to a waiting getaway vehicle.
On February 29, 2016, Simmons and the juvenile robbed the same Walgreens. In this robbery, the pair took a pill bottle with a tracker on it, which was tracked back to an apartment complex. Officers did not locate the suspects, but they did find the getaway vehicle. Inside the vehicle, officers located clothing consistent with clothes worn by the suspects as well as a pellet gun. Simmons and the juvenile were later arrested in San Joaquin for committing a similar robbery. They were both linked to the Sacramento robberies through clothing and prints. Simmons pled guilty to the robbery in San Joaquin County.
Simmons faces a maximum sentence of 21 years, 4 months in prison. Sentencing is set for May 28, 2019, at 9:00 a.m. in Department 28 before the Honorable Richard Sueyoshi.
