The District Attorney’s Office is continuing its review of the March 18, 2018, officer-involved shooting of Stephon Clark. As always, our review will only address the question of whether the conduct of the two Sacramento Police officers constitutes a prosecutable crime under established California law. The California Attorney General’s Office has previously indicated it will also conduct an independent review of the incident.

On October 25, 2018, this office received the voluminous investigative report and related materials from the Sacramento Police Department regarding the shooting. Two weeks ago, on January 16, 2019, we received further substantial investigative reports and related materials from the Attorney General’s Department of Justice investigators. Our timeline for completion of our review has thus been delayed as we process the supplemental materials. We will take whatever time is needed to ensure a fair, thorough, and accurate review of this matter.

Because this matter is under review and is still pending, ethical obligations prevent us from commenting further at this time. Once a decision is made, details will be provided. If you have questions regarding the officer-involved shooting review process, a copy of the review protocol is available here and answers to Frequently Asked Questions are available here. If you would like to leave a message for the District Attorney’s Office regarding our review of this shooting, you can send an email to OIS@sacda.org or call (916) 874-2000.
