District Attorney Jan Scully announced today that charges of assault with
intent to commit rape were dismissed against a sixteen year old minor in
Sacramento Juvenile Court this morning. The dismissal motion was made by the
District Attorney’s Office and granted by the Honorable Kenneth G. Peterson,
Presiding Judge of the Sacramento Juvenile Court.
The
charges stemmed from the attempted rape of a student teacher at Hiram
Johnson High School on February 15, 2005. The initial investigation had
pointed to this sixteen year old minor as the perpetrator. Evidence
uncovered during the beginning of the trial demonstrated that this minor was
not the responsible party. There is some evidence that another individual
committed this offense. An investigation will be sought into the individual
now believed to be the perpetrator.
Judge Peterson in granting the motion to dismiss
commented that the trial evidence that had already been presented left him
with serious doubts as to the accuracy of the eyewitness identification of
this sixteen year old minor.
