District Attorney Jan Scully today announced the jury trial conviction of Sergio Calhoun & Jarvell Smart for charges involving firing at an occupied motor vehicle causing serious bodily injury and attendant gang allegations. On March 29, 2004 in the G-Parkway area, the defendants engaged in a massive gun battle with rival gang members, in which two innocent individuals seated in a car in between the two groups received most of the gunfire. Both victims were seriously injured, but fortunately they survived. The defendants were 15 years old at the time of the offense and now face prison sentences of 65 years to life and 50 years to life, respectively.
Deputy District Attorney Thomas Asker, who prosecuted the case, indicated, “this is yet another example of what happens when multiple teenagers, committed to a lifestyle of crime, arm themselves to the teeth and look for any excuse to fire their weapons. It can only be stopped by permanently taking gangsters like these defendants off the street.”
