District Attorney Jan Scully announced today
that Dr. David Michael McCann, age 60, pled guilty to one felony violation
of unlawfully maintaining a place for the purpose of giving away controlled
substances, four misdemeanor charges involving domestic violence, illegally
possessing a firearm, excessively prescribing drugs, and practicing
medicine while under the influence. Pursuant to a plea agreement, Dr.
McCann will be placed on felony probation, participate in the Sheriff's
Work Project, and surrender his medical license to the Medical Board
of California. He will be sentenced in Superior Court on June 16, 2004.
Dr. McCann had been a practicing physician here
in Sacramento since 1986. On February 5, 2003, the Sacramento Sheriff's
Department began an investigation when his live-in girlfriend reported
she had been assaulted. During a search of his home and later his medical
office, law enforcement determined Dr. McCann had been illegally furnishing
controlled substances to his patients and friends. In addition, a loaded
handgun was found in Dr. McCann's office desk drawer, which he was prohibited
from possessing because he was subject to a domestic violence restraining
order. After interviewing office personnel and patients, law enforcement
learned Dr. McCann had often practiced medicine while under the influence.
Deputy District Attorney Ruanne Dozier stated,
"Our investigation revealed not only was Dr. McCann guilty of domestic
violence but he was habitually providing his friends and patients with
controlled substances for non-medical purposes. Because of the efforts
of multiple agencies during this investigation, we are pleased Dr. McCann
may never have the opportunity to practice medicine again in California."
