District Attorney Jan Scully announced today
that Emery Dennis Spencer was found guilty of 18 counts of child molestation,
including two counts of Penal Code section 288(b) - forcible sex acts
with a child. In addition, Mr. Spencer was convicted of possessing child
pornography and exhibiting harmful matter (pornography) to the 12-year-old
victim.
The jury heard five days of testimony, including
that of the victim, who testified that the defendant had been engaging
her in numerous sex acts, including oral copulation and digital penetration.
The acts took place in the defendant's home, while his wife was out,
as well as in the victim's home, while her father was at work. The victim's
father testified that he entrusted the care of his daughter to the defendant
because he considered him one of his best friends. On June 20, 2003,
the victim's father left for work, but returned unexpectedly about 15
minutes later and found the defendant with the victim, engaged in what
appeared to be a molest. The police were notified, at which time the
victim reported that the conduct had been ongoing. A subsequent search
of the defendant's apartment, including his computer hard drives, revealed
numerous images of child pornography and printouts from web sites depicting
what appeared to be minors and under-developed young women engaged in
sex acts. As is often the case in child molestation cases, there was
no DNA evidence.
Deputy District Attorney Valerie Brown stated
that she was gratified by the jury's diligence and careful examination
of the evidence. "Not only can the evidence in these type of cases
be difficult to listen to and view, but it forces recognition of the
disturbing truth that child molesters exist in all walks of life - sometimes
even those we trust most."
Mr. Spencer will be sentenced by Judge Troy Nunley
on May 14, 2004. He faces a maximum of 49 years in state prison.
