On March 2, 2004, the Sacramento
District Attorney's Office will file an Amended Original Petition adding
a hate crime enhancement to the pending charges of conspiracy to commit
murder and attempted burglary.
The two 15 year-old Laguna Creek High School students were arrested
on February 8th and 10th, respectively. The arrests came as a result
of an investigation by the Elk Grove Police Department and the Sacramento
County Sheriff's Department.
After the District Attorney's Office received
the completed reports from the Sheriff's Department last week, we reviewed
those reports to determine what additional charges might be appropriate.
Statements and other evidence in the reports support the conclusion
that the juveniles conspired to commit the crime of murder because of
the race and color of some of the victims.
The Amended Original Petition will allege that
the juveniles plotted to kill one identified African American student,
other unidentified African American students, and other non-African
American students at Laguna Creek High School. The juveniles face a
maximum confinement at the California Youth Authority until the age
of 21.
