District Attorney Jan Scully announced
today that Kenn Bican (20) of Fair Oaks was sentenced by the Honorable
Jane Ure to five years of probation and eight months in the county jail
following his conviction of vehicular manslaughter in violation of Penal
Code section 192(c)(1). Bican was ordered to serve three months of actual
custody in the jail and the remainder may be served on work furlough,
with credit on the work furlough given for any hours of community service
that Bican serves talking to students about the dangers and consequences
of street racing.
On September 22, 2002, Bican, the victim,
and several others met on Younger Creek Road near Elder Creek Road at
approximately 2:00 a.m. This is an area known for street racing. The
victim, who was riding a Suzuki motorcycle, and the defendant, who was
driving a Mitsubishi 3000GT, agreed to drag race. Near the end of the
race, the victim lost control of his motorcycle and crashed into a concrete
sign. He died as a result of his injuries. The defendant fled the scene.
Law enforcement investigators were able to identify the defendant through
an anonymous tip to Crime Alert. Upon contact with investigators, the
defendant admitted his involvement in the race.
Deputy District Attorney Michael Blazina,
who prosecuted the case, stated, "Street racing is an inherently dangerous
act in which participants, onlookers, bystanders, and other motorists
can be killed or seriously injured. Hopefully, the defendant will be
able to spread the word to the youth of our community through his community
service that anyone engaging in this conduct will be held accountable,
even if they are not the one who crashed or personally injured someone.
As the victim's mother so aptly stated at the sentencing hearing, 'There
truly are no winners in street racing.'"
