Jan Scully announced today, that defendants' Johnny Galliano &
Kevin Bennett have plead guilty to violation 597(a) P. C. (Felony Animal
Cruelty)
On March 5, 2001, defendants encountered "Mario", a neighbor's
small dog in their garage. They proceeded to douse the dog with gasoline
and set the dog on fire. Fortunately, the dog ran home where his owner
put out the fames immediately so that "Mario" suffered only
minor burns.
Defendant Galliano plead to a 4-year suspended state prison commitment
in conjunction with another case, with imposition of 1 year of county
jail. Galliano's pleas constituted a "Strike" under provisions
of current "3 Strike" law. Co-defendant Kevin Bennett plead
to 90 days county jail with 5 years formal probation.
Additionally, both defendants will be prohibited from owning any domesticated
animals for 5 years and be ordered to undergo counseling.
Sentencing is scheduled for June 12, 2001 at 8:30 a.m. before the Honorable
Patrick Marlette in Department 63.
