Robert Faler was convicted by a jury of attempted murder, shooting at an occupied vehicle, and being a felon in possession of a firearm. The jury found true allegations that the crimes were committed for the benefit of and/or in association with the Sureño criminal street gang, and that Faler personally used and discharged a firearm during the commission of the offenses. It was also found that Faler had been previously convicted of robbery and served a prison term for that offense.
On July 18, 2014, the victims crossed paths with Robert Faler and his former co-defendant, Alexis Lopez, while at a gas station on Arden Way. Lopez drove to the station with Faler in the front passenger seat. Faler and Lopez were both Sureño gang members, and Lopez believed he recognized the victims as rival Norteño gang members. After the victims drove away, Lopez followed them and caught up to them as they drove on Arden Way near the Arden Fair mall. Faler fired multiple shots at the victims’ car and flashed gang signs before Lopez drove away. The victims’ car was hit by three bullets, one of which entered the front passenger compartment.
Faler faces a maximum sentence of 55 years to life in prison. Sentencing is scheduled for August 4, 2017, at 9:00 a.m. in Department 23 before the Honorable Geoffrey Goodman.
