Defendant Convicted of Communicating
 with a Minor to Commit a Lewd Act

Carl Simmermacher was convicted by a jury of felony communicating with a minor to commit oral copulation or sodomy, and misdemeanor annoying or molesting a child under 18.

In November of 2012, Simmermacher commented on a photo that the female victim had posted on her Facebook page. The two began direct messaging and she told him that she was 15 years old (she was in fact 13 years old). Over the next five days, Simmermacher sent her numerous sexual messages, stating he could pick her up in his car, bring her to his apartment, and teach her about sex.  Simmermacher described the various sex acts he wanted to perform on her. The chat was interrupted after the victim’s mother messaged him directly, telling him to stop communicating with her daughter.

Simmermacher faces a maximum sentence of 1 year, 6 months in prison. He will also be required to register as a sex offender for life. Sentencing is set for February 27, 2017, at 1:30 p.m. in Department 61 before the Honorable Michael Sweet.
