PROSECUTOR: Deputy District Attorney Maria Wilson, Adult Sexual Assault Prosecution Unit
David Hamilton pled no contest to forcible rape and admitted an allegation that the rape occurred during the commission of a first-degree burglary. Hamilton also admitted a prior 2014 robbery strike conviction.
At approximately 3:00 a.m. on February 7, 2017, Hamilton entered the victim’s home through her kitchen window. Hamilton, who was a stranger to the victim, grabbed a knife and entered the victim’s bedroom. Hamilton told the victim to get on the floor and threatened to kill her if she did not cooperate. He then bound the victim’s hands, choked her and raped her. After the assault, Hamilton began walking around the house. The victim, who was scared he would hurt her sleeping children, was able to distract Hamilton by offering him food and drinks. During this time she was able to call 911 and send a text for help. When officers arrived, they found Hamilton hiding under the victim’s couch with the knife.
Hamilton will be sentenced to 30 years to life in prison. Sentencing is set for January 9, 2018, at 8:30 a.m. in Department 60 before the Honorable Stephen Acquisto.
