In a court trial, the Honorable Cheryl Meegan found Charles Fowler-Scholz guilty of two counts of second-degree murder, attempted murder, assault with a firearm, and assault with a deadly weapon. Judge Meegan also found 12 prior strike convictions to be true. Those prior strike convictions included 11 robberies and attempted robbery.
On New Year’s Eve 2012, victim Gabriel Cordova accidentally spilled a drink on Amber Scholz inside a bar in Old Town Sacramento. The two got into an exchange of words. Amber Scholz informed her husband, Charles Fowler-Scholz, and Carlito Montoya of what happened. The defendants went over to Mr. Cordova and surrounded him. Fowler-Scholz then slammed his beer bottle on Mr. Cordova’s face. Bar security officer, Daniel Ferrier, attempted to break-up the struggle. Montoya fired several rounds into Mr. Ferrier, killing him. Another security guard, Stephen Walton, attempted to intervene and Montoya fired at him as well. Soon after, Montoya fired several shots at Mr. Cordova, killing him. Mr. Cordova’s wife, Christina Cordova, also sustained a gunshot wound.
Montoya was previously convicted of two counts of first-degree murder, premeditated and deliberate attempted murder with an infliction of great bodily injury enhancement, and assault with a firearm. Gun and gang enhancements were found true on all charges.
Montoya faces a maximum sentence of life without the possibility of parole plus an additional 140 years. Fowler-Scholz faces a maximum sentence of 120 years to life in prison. Sentencing for both defendants is scheduled for May 12, 2016, in Department 18 before the Honorable Cheryl Meegan.
