Defendant Convicted of Felony Animal Cruelty

Fifty-eight-year-old David Earl Billoups was convicted by jury of felony animal cruelty.

Billoups and Lynda Witherspoon were in a romantic relationship. On February 19, 2015, Billoups went to Ms. Witherspoon’s residence and the two argued in her bedroom. When Ms. Witherspoon told Billoups she wanted to end the relationship, Billoups walked out of the room.  Ms. Witherspoon then heard Billoups curse at her two-month-old Pit Bull puppy “Baby,” followed by a thumping noise. When she ran out of her bedroom, she saw Baby twitching.  The dog died at the residence.

Sacramento Animal Care Services performed a necropsy of Baby and determined the dog had two broken vertebra, a fractured skull, and bruising on the skull.

Billoups faces a sentence of 5 years in prison.  Sentencing is set for March 17, 2016, at 9:00 a.m. in Department 13 before the Honorable Matthew Gary.
