CASE: Markas Fulgham & Latanya McLeod

District Attorney Anne Marie Schubert announced that on July 28, 2015, 28-year-old Markas Fulgham and 30-year-old Latanya McLeod pled no contest to felony insurance fraud. Both defendants were sentenced by the Honorable John Sapunor to 90 days county jail, 5 years formal probation and ordered to pay $2,000 in restitution.
On December 30, 2013, Fulgham was driving McLeod’s car and was involved in an accident in downtown Sacramento. The insurance carrier of another vehicle in the accident investigated and found Fulgham at fault. McLeod’s car sustained damage to the passenger side front and rear doors, but she did not repair it since she was uninsured.
On January 23, 2014, McLeod called Fulgham’s sister’s insurance company claiming Fulgham’s sister drove her car and caused damage to the front and rear passenger doors. Fulgham’s sister told her insurance company the car was already damaged from an earlier accident. The insurance company obtained the file from the insurance carrier of the other vehicle involved in the December accident. Photographs of the damage from the December accident were identical to photos taken of McLeod’s car on January 23, 2014. When interviewed by the insurance company, both defendants denied pre-existing damage to the car and maintained Fulgham’s sister caused the damage. Interviews of Markas Fulgham’s mother and stepmother supported his sister’s statement. McLeod ultimately admitted she lied about the pre-existing damage to her car because she did want to pay for repairs.
Insurance fraud is committed when an individual reports to an insurance company fraudulent information regarding an accident, regardless of whether the insurance company pays the claim or suffers financial loss.
