District Attorney Anne Marie Schubert announced that 38-year-old Francisco Ramirez was convicted by jury of raping an unconscious person.
Ramirez was a friend of the victim and her husband. On November 19, 2011, the victim was drinking at a party she and her husband threw for their daughter. Later that night, she was driven home and passed out. Ramirez showed up at the apartment and drank with the husband, who eventually passed out. When the victim woke up, Ramirez was on top of her. She pushed him off, and passed out again. She later woke and realized her panties were missing. DNA testing confirmed Ramirez had sexual intercourse with her.
Ramirez faces a potential maximum sentence of 8 years in prison. Sentencing is set for August 21, 2015 at 10:30 a.m. in Department 27 before the Honorable Delbert Oros.
