District Attorney Anne Marie Schubert announced that Gary Dale Baker was convicted by jury of nine charges including rape, forcible oral copulation, felony sexual battery, and first-degree burglary. The jury also found true allegations of committing a rape during the course of a first-degree burglary and the victim was over the age of 65 at the time the crimes were committed.
On November 24, 2010, Baker sexually assaulted the 75-year-old victim in her residence at a south Sacramento senior living apartment complex. Although DNA evidence was located, there were no matches to a possible suspect. On September 20, 2012, the same suspect returned and again sexually assaulted the victim, who was then 77 years old. DNA evidence was obtained, but there were again no matches to a possible suspect. On December 11, 2012, the suspect returned to the victim’s residence a third time and attempted to sexually assault her. He fled before completing the acts. A Sacramento police detective suggested the victim’s family install a motion activated camera in an attempt to obtain an image of the suspect. On December 18, 2012, the suspect returned and attempted to gain entry. Detectives reviewed the footage and immediately recognized the person to be then Sacramento Police Officer Gary Baker. Baker was arrested and terminated from the Sacramento Police Department on December 20, 2012. The District Attorney’s Laboratory of Forensic Services confirmed that Baker matched DNA evidence taken from the victim and the crime scene in 2010 and 2012. The victim suffered a stroke in 2009, resulting in aphasia which makes verbal communication challenging for her. She was unable to testify at trial due to this condition as well as other health issues.
Baker faces a potential sentence of 53 years plus two life terms in state prison. Sentencing is set for August 17, 2015 in Department 17 by the Honorable Ernest Sawtelle.
