Gang Members Convicted of Murder & Conspiracy

CASE:  Hector Caballero & Damian Flores

Twenty-year-old Hector Caballero was convicted by jury of first-degree murder and conspiracy to commit a crime.  Twenty-five-year-old Damian Flores was convicted of second-degree murder and conspiracy to commit a crime.  The jury also found gun and gang allegations true for both defendants.

Caballero and Flores are Norteños gang members.  On November 23, 2013, they walked the neighborhood of their rival Sureños gang confronting individuals they thought were members.  They approached Ricardo Guerro and asked if he was a Sureño.  Mr. Guerro said he was not a gang member, and he was not intimidated by them.  Perceiving this response as disrespectful, Caballero shot him twice.  The victim died almost instantly. 

Once incarcerated, both defendants attempted to send notes to fellow gang members directing them to intimidate and threaten witnesses.  The notes were eventually confiscated by law enforcement. 

Caballero has two prior strike convictions, both gang related felony assaults. Flores has a prior strike conviction, a felony assault with a firearm.  

Both defendants face a maximum potential sentence of life in prison without the possibility of parole.  Sentencing is set for November 5, 2015 at 1:30 p.m. in Department 26 before the Honorable Curtis Fiorini.
