Gang Member Convicted for Del Paso Heights Shooting

Joseph Fair was convicted by a jury of attempted murder and assault with a firearm.  The jury also found true multiple allegations that Fair personally used a firearm, personally and intentionally discharged a firearm causing great bodily injury and paralysis, and that Fair committed the offenses for the benefit of, at the direction of, or in association with the criminal street gang Del Paso Heights (DPH) Bloods.

On December 12, 2014, the victim and his brother went to a well-known DPH Bloods hangout on Marysville Boulevard in Del Paso Heights.  When a DPH Blood member started a fight with the victim, the victim was thrown out of the club.  Joseph Fair followed the victim outside, and then shot him in the back. The bullet caused damage to the victim’s spine and aorta, resulting in permanent paralysis. 

Fair faces a maximum sentence of 34 years to life in prison.  Sentencing is set for August 16, 2017, at 9:00 a.m. in Department 20 before the Honorable Michael Bowman.
