Demetrious Marcus was convicted by a jury of two counts of robbery and assault with a deadly weapon. The jury found true a personal use of gun allegation on all three counts. Marcus was also convicted of being a felon in possession of a firearm.
On March 27, 2017, two suspects entered the victim’s apartment, pistol whipped the victim’s father and demanded money from the victim. The victim and his son were held at gunpoint while the two suspects ransacked their home, stealing their personal items. When the victim and his son chased the two suspects out of the apartment, one of the suspects shot the victim in the back before fleeing in a getaway car. The victim provided a description of the suspects, but they were not immediately caught. A few months later, the victim was able to identify Marcus as one of the robbers, but was not able to determine if he was the shooter. The other suspect has not yet been identified.
An allegation that Marcus suffered a prior 2009 strike conviction for residential burglary was found true. Marcus’ criminal history dates back to 2007, including additional convictions for domestic violence and multiple vehicle thefts.
Marcus faces a maximum sentence of 38 years in prison. Sentencing is set for March 22, 2018, at 9:00 a.m. in Department 42 before the Honorable Allen Sumner.
