Defendants Sentenced for Natomas Apartment Shooting Death

CASE:  Dezmon McClary & Charles Johnson (Case #15F06105)

PROSECUTOR:  Deputy District Attorney Kevin Greene, Homicide Unit

The Honorable Marjorie Koller sentenced Dezmon McClary to 50 years to life in prison and Charles Johnson to 5 years, 8 months in prison.  On December 8, 2016, a jury convicted McClary for the first-degree murder of Marcus Gonzalez.  The jury also found true the allegation that McClary intentionally and personally discharged a firearm causing death.  Charles Johnson was convicted of involuntary manslaughter while armed with a firearm, and felon in possession of a firearm.

McClary had been dating a resident of the Natomas Park Apartments. On October 8, 2015, McClary became aware that his ex-girlfriend was seeing a new boyfriend. The next day, McClary and Johnson went to the ex-girlfriend’s apartment. McClary, who was armed with a shotgun, and Johnson, who was armed with a handgun, entered the apartment through an unlocked door. McClary located Marcus Gonzalez and believing him to the new boyfriend, shot him with the shotgun.
