Defendant Sentenced for Murder of Infant

PROSECUTOR:  Deputy District Attorney Timothy Carr, Special Assault & Child Abuse Unit

The Honorable Steve White sentenced Damian Porter to 25 years to life in prison.  On November 29, 2016, a jury convicted Porter for the second-degree murder of Graeson Byrd and assault on a child resulting in death.  A separate jury acquitted co-defendant Davonna Rae Byrd, the victim’s mother.  

On April 8, 2013, Porter was home alone with 11-week-old Graeson from early in the morning until 911 was called later that afternoon.  When medical personnel arrived, Graeson was not breathing and did not have a heartbeat.  The child was pronounced dead when he arrived at the hospital a short time later.  Medical evidence showed Graeson had sustained a serious head injury that caused his death, and that Graeson had sustained numerous other injuries inflicted over several weeks.  Among those injuries were rib, arm, and leg fractures.
