District Attorney Anne Marie Schubert announced that 31-year-old David Acuna was convicted by jury of first-degree murder, personal use of a weapon, arson and use of an accelerant. Thirty-two-year-old Guadalupe Cabrera pled no contest to arson, use of an accelerant and accessory after the fact to murder.
On February 1, 2013, Acuna knocked Patrick Kendrick unconscious during a dispute over electronics. Acuna then dragged Mr. Kendrick into the kitchen and stabbed him seven times in the neck and back, killing him. Acuna left the scene and asked Cabrera to help him obtain materials to craft two Molotov cocktails. Both defendants returned to the apartment and started a fire in an attempt to conceal evidence of the homicide.
Acuna faces a maximum potential sentence of 39 years to life in prison. Under the plea agreement, Cabrera will be sentenced to 9 years in prison. Both defendants will be sentenced on June 5, 2015 at 9:00 a.m. in Department 31 before the Honorable Michael Kenny.
