CASE: Xou Thao & Xong Moua
PROSECUTOR: Deputy District Attorney Carlton Davis, Gangs & Hate Crimes Unit
District Attorney Anne Marie Schubert announced today that Xou Thao was convicted by jury of aiding and abetting the shooting of an occupied vehicle and aiding and abetting the assault with a firearm of two Sacramento Bee newspaper carriers. Thao was also found guilty of committing the crimes for the benefit of the Junior Criminal Crips gang.
Thao and Xong Moua saw two Sacramento Bee carriers delivering papers at 3:45 a.m. on January 2, 2012. Thao mistook them for rival gang members because they were wearing bandanas to shield their faces from the cold weather. Thao drove next to the victims’ vehicle and stopped his car so his passenger, Moua, could fire numerous shots at the vehicle. The victims’ vehicle and houses on the street sustained bullet holes from the shooting.
Moua previously pled no contest to assault with a deadly weapon or firearm and was sentenced to 19 years in prison.
Thao faces a potential maximum sentence of approximately 23 years to life in prison. Sentencing is set for May 15, 2015 at 9:00 a.m. in Department 33 of the Sacramento Superior Court.
