Prosecutor: Deputy District Attorney Tate Davis, Elder Abuse Unit

 

District Attorney Anne Marie Schubert announced that Michael Diaz was convicted by jury of felony elder abuse, and felony assault with a deadly weapon. 

 

On July 28, 2014, Diaz attacked his 70-year-old relative, who was partially paralyzed from a stroke.  He grabbed her out of her wheelchair, threw her onto the ground, pulled her hair and smashed her head on the ground.  Diaz’s disabled adult brother attempted to come to the victim’s rescue.  Diaz then assaulted his brother with a deadly weapon.

 

Diaz has numerous prior felony convictions including false imprisonment, unlawful sexual intercourse, assault with a firearm, possession of a deadly weapon, and multiple vehicle thefts.  He also has several misdemeanor convictions including multiple domestic violence batteries, corporal injury to a dating partner, possession of stolen property, and possession of a controlled substance.

  

Diaz faces a maximum potential sentence of 19 years in state prison.  Sentencing is set for February 20, 2015 in Department 42 before the Honorable Laurence Brown.
